Website and Platform Terms
These terms govern use of the Ghayth website and platform, account creation and free trials. A paid subscription may also be governed by the Master Subscription Agreement, Order Form and linked policies.
1. Service provider
The platform is provided by Ghayth Al Mada Establishment, Commercial Registration 7053490558.
Contact and support: support@ghayth.com.sa.
2. Eligibility and authority
Ghayth commercial subscriptions are primarily intended for businesses. A user who creates an account or accepts an offer on behalf of an organisation represents that they have authority to bind it. Information provided must be accurate and kept current.
3. Accounts and security
Users are responsible for protecting credentials, assigning appropriate employee permissions and preventing unauthorised sharing of administrative accounts. Suspected compromise or unauthorised access must be reported promptly.
4. Service and subscription
The published plan, quotation or Order Form specifies features, limits, branches, users, billing cycle and term. Ghayth may provide a free trial for the duration and status displayed by the platform. Marketing statements do not override an accepted quotation or Order Form.
5. Pricing, payment and tax
The price and billing cycle are shown before subscription. VAT or other mandatory tax is added as required by law unless expressly stated to be included. Payments may be processed by تحويل بنكي يدوي or another provider shown at checkout.
6. Electronic contracting and records
Subscriptions, acceptances and notices may be completed electronically. Ghayth may retain appropriate evidence including the accepted version, version number, timestamp, accepting identity and verification method. Electronic records are relied upon in accordance with applicable law.
7. Merchant operations and ordering
Ghayth may provide POS, customer ordering pages, digital menus, dine-in, pickup or delivery orders, and connections to kitchen and inventory operations. The subscriber remains responsible for its products, pricing, descriptions, availability, customer-facing policies, fulfilment quality and delivery unless a separate agreement states otherwise.
8. E-invoicing and tax
Ghayth may provide e-invoicing, accounting and tax functions based on configured data and settings. The subscriber remains responsible for the accuracy of its legal and tax information, transaction classification and obligations as the taxpayer or supplier.
9. Acceptable use
The Acceptable Use Policy applies. Unauthorised access, service disruption, circumvention of security restrictions, unlawful activity and infringement of third-party rights are prohibited.
10. Third-party services
Some features may depend on hosting, payment, messaging, delivery, mapping, government or other integration services. Those services are also subject to their providers' terms and availability, and Ghayth does not control the continued operation of third-party systems.
11. Intellectual property
Rights in the Ghayth platform, software, designs, marks and Ghayth-owned content remain with Ghayth or its licensors. Use of the service does not grant source-code, reproduction, resale or reverse-engineering rights except where required by law or expressly permitted in writing.
12. Privacy
Personal-data processing is governed by the Privacy Policy, Cookie Policy and, where applicable, the Data Processing Agreement.
13. Cancellation and refunds
The Cancellation, Refund and Renewal Policy and accepted Order Form apply. Mandatory statutory rights applicable to a particular case prevail over conflicting contractual terms.
14. Suspension and termination
Access may be suspended for a material security risk, unlawful use or continued non-payment following appropriate notice, subject to applicable legal and contractual rights. Data export, retention and deletion procedures apply when a subscription ends.
15. Liability
Ghayth provides the service with reasonable professional care. Accounting or tax outputs do not replace the subscriber's responsibility to review its data and obligations. Liability limitations in the Master Subscription Agreement apply to the extent permitted by law.
16. Governing law and updates
These terms are governed by the laws of the Kingdom of Saudi Arabia. They may be updated when the service or legal requirements materially change. The published copy shows its version and effective date.
